| Affiliate Program Agreement |
This agreement describes the entire terms and conditions for participation in the EverythingEquus.com Affiliate Program owned and operated by ITLogy, LLC at 71 Little Buck Creek Rd., Underwood, WA 98651.
In this agreement, the term "Affiliate" refers to you (the applicant). Wherever the agreement refers to "you" or "your", it means "the Affiliate"; "I", "we" or "our" refers to EverythingEquus.com.
Enrollment in the EverythingEquus.com Affiliate Program
Submit a complete Program application via our site. You will be granted a provisionary acceptance to start using the Affiliate program as long as you are in one of the following countries: USA, Canada, UK, Australia, New Zealand. We will evaluate your application in good faith and will notify you within 1 week if it is rejected. We may reject your application if we determine (in our sole discretion) that your site is unsuitable for the Program for any reason. Unsuitable sites include (but are not limited to) those that:
- Contain content that is unlawful, threatening, defamatory, obscene or otherwise objectionable;
- Promote sexually explicit materials;
- Promote violence;
- Promote discrimination based on race, sex , religion, nationality, disability, sexual orientation or age;
- Promote illegal activities;
- Violate or infringe upon intellectual property rights.
- Participate in sending SPAM (unsolicited email)
If we reject your application, you are welcome to reapply to the Program at any time. If we accept your application, we reserve the right to terminate this Agreement if we ever determine that your site is unsuitable for the Program for any reason.
Any Affiliate who, in our opinion, breaches the conditions mentioned above will have their Affiliate status cancelled immediately and any and all outstanding commissions WILL BE FORFEITED.
Due to an increasing amount of International fraud - this program is limited to people living in the US, Canada, UK, Australia, and New Zealand. If you do not live in one of these countries and you would like to participate AND receive commissions, please send an e-mail to: info@EverythingEquus.com. Please include information about your web site, the URL and details about your visitors and/or your opt-in list, etc. If you are not granted an exception, no commissions will be paid.
Affiliate Site
Code for links to EverythingEquus.com will be provided through a password protected page on EverythingEquus.com. You may choose which links to place on your site from the icons, banners or text links provided in your Affiliate Account. Only those items shown in your account may be used. Using links other than those provided cannot be tracked and will not earn commissions.
Commissions and Payments
You will receive up to 25% (determined by product and quantity – See commission schedule below) of the revenue as a commission from orders placed through your Affiliate Site. For a sale to generate a commission to an Affiliate, the customer must complete the transaction resulting in a paid order on EverythingEquus.com. Commissions will only be paid on sales which are made through approved Affiliate Sites.
Commission will be paid on transactions 90 days after they have been posted and accrued commission is greater than or equal to $50.00 USD.
Commission will not be paid if an ad has been refunded or had a chargeback to the credit card.
If an ad commission has been paid and then refunded or had a chargeback to the credit card, we will deduct that commission from your next payment or payments.

Sales Tracking
You can track your sales and payments via the EverythingEquus.com Affiliate management page. EverythingEquus.com will make available to you the sales activity, as well as reports regarding end-user sale generated by your Affiliate site.
Relationship of Parties
You, the Affiliate, and EverythingEquus.com are independent contractors and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict this statement.
Policies and Pricing
All customers who buy products through the Program are customers of EverythingEquus.com. Accordingly, all EverythingEquus.com rules, policies and operating procedures concerning customer orders, customer service, pricing and product sales will apply to those customers. We may change our policies and operating procedures at any time, in our sole discretion. Product prices and availability may vary from time to time. Because price changes may affect products that you already have listed on your site, you may not include price information in your product descriptions. We will use commercially reasonable efforts to present accurate information, but we cannot guarantee the availability or price of any particular product.
Indemnification
You will indemnify, defend and hold us harmless against any and all claims, lawsuits, damages, and expenses (including, without limitation, attorneys’ fees) that we may or that anyone may assert as a result of anything occurring on your site or arising from the development, operation or maintenance of your site.
Limitation of Liability
We will not be liable for indirect, special or consequential damages (or any loss of revenue, profits or data) arising in connection with this agreement or the program, even if we have been advised of the possibility of such damages. Further, our total liability arising with respect to this agreement and the program will not exceed the total referral fees paid or payable to you under this agreement.
